As of October 15, 2025, Massachusetts law (760 CMR 74.00) prohibits sellers from accepting offers that waive or restrict a buyer’s right to a home inspection. Every buyer now has a legal right to a home inspection performed by a licensed Massachusetts inspector. You may choose not to inspect, but that right cannot be removed from your offer by a seller or agent. This law applies to residential properties of one to four units.
